Court Costs in Iranian Legal System

In Iran’s legal system, same as any other legal system, to file a legal action or carry out other matters in the process of a case, some costs need to be paid by the litigants.

In this article by Karimi & Associates Law Firm, we will discuss these costs in different courts and legal forums of Iran’s legal system.

As mentioned in the “Legal System of Iran” article, to commence legal action, a legal petition must be arranged and submitted to the court. Arranging a legal petition in each state of procedure, including the preliminary stage, appealing, and appeal to the supreme court has its specific costs which need to be paid by the petitioner.

However, in this article, we discuss the court costs in all kinds of petitions and courts and not just civil courts.

Civil Courts, Family Courts, and Dispute Resolution Councils

As we mentioned, one of the first steps in submitting a petition and starting a legal action is paying the judicial fees for legal matters, including financial and non-financial actions.

Judicial and court fees in civil actions such as family actions, legal actions, and the actions under the jurisdiction of the Dispute Resolution Council are noted in the table below:

The cost of non-financial actions, requesting for gathering the evidence and security for relief sought, in all judicial authorities, depending on the type of the action (according to the directive of the Head of the Judiciary) From 400,000 Rials to 1,800,000 Rials
The cost of protesting and appealing the orders that can be appealed, in the court and the Supreme Court 300,000 Rials
The cost of matching documents with their originals, in the offices of the courts, the Administrative Court of Justice and other judicial authorities 15,000 Rials
The cost of requesting image of the case papers, per each paper 50,000 Rials
The cost of issuing a certificate from the offices of judicial authorities 50,000 Rials
The cost of matching the copy and image with the original, in each case 300,000 Rials
The cost of submitting official notification and protest letter, in each case 100,000 Rials
The cost of the translator’s signature certificate by the court, for each case 300,000 Rials
Stamping fees for documents translated by an official judicial translator 300,000 Rials
The cost of the stamp of the certificate of authenticity of the translation, in each case 300,000 Rials
The cost of proceedings in accordance with Article 477 of the Criminal Procedure Law approved in 2012 300,000 Rials

 

It is notable that to calculate the costs of your legal action, you can use Judicial Electronic Service Portal commonly named as Adliran Portal.

Dispute Resolution Councils

Not all legal actions are submitted to civil or family courts. In some circumstances mentioned in the “Legal System of Iran” article, the legal action shall be submitted to the Dispute Resolution Council.

The judicial costs of this council are same as the costs in civil and family courts, except some cases which are noted in the table below:

Establishing peace and reconciliation between the parties, with their consent Free of charge

Enforcement of Civil Judgments

After the judge’s judgment and decision gets finalized by passing the appeals stage, the court’s decision will be a verdict which has to be enforced by another subsidiary of the judicial system of Iran; entitled as Enforcement of Civil Judgments. As the ultimate purpose of submitting a legal action is the implementation of the court’s decision, this stage of the legal action’s process is the most important stage. Therefore, it is important to be informed of the costs of this stage of civil procedure.

The judicial costs at the stage of Enforcement of Civil Judgements are as below:

The cost of enforcement of financial actions’ judgements 5 % of the object of judgment/judgment debt
The cost of enforcing the judgments of non-financial actions and the judgments in which the object of judgment/judgment debt is not evaluated, and the cost of enforcing the opinions and decisions of non-judicial bodies (according to the directive of the Head of the Judiciary) From 400,000 Rials to 1,800,000 Rials
The cost of temporary enforcement of judgments in all judicial authorities 300,000 Rials
The cost of a third person/party objection to the enforcement of civil judgments 200,000 Rials
The cost of enforcement of family courts’ decisions 400,000 Rials
The cost of enforcement of other verdicts and decisions From 1,000,000 Rials to 1,800,000 Rials

 

Administrative Justice Court

Same as other legal actions, submitting a legal action to the Administrative Justice Court also requires paying the judicial costs and fees, as below:

Criminal Courts

In the process of a criminal complaint, same as legal actions in civil courts and similar authorities, there are some costs that the complainant (petitioner of the criminal complaint) shall pay to the Judicial System.

(According to Note 1, Article 560 of the Criminal Procedure Law, the cost of filing a complaint of financially incompetent persons is paid from the judicial branch’s funds, at the discretion of the prosecutor.)
